A judge expressed frustration with Díaz de la Portilla, and said that it was “no longer possible for me to coerce compliance because your client is not going to do it.” The judge continued, saying “he is going to continue to vilify his wife; he is going to continue to thumb his nose at this Court and to challenge my authority.”

A trial court held Díaz de la Portilla in civil contempt for failing to turn over the dog, and criminal contempt for failing to show up to court after he failed to give the dog to his ex-wife, lobbyist Claudia Davant.

"At this juncture in this case it is my opinion that it is no longer practical, no longer possible for me to coerce compliance because your client is not going to do it,” the trial court judge said. "He is going to absent himself; he is going to continue to vilify his wife; he is going to continue to thumb his nose at this Court and to challenge my authority to enforce not only my Orders but the Orders of [the predecessor judge.]"
